TimeCert is a tool intended to assist employers in complying with proper timekeeping requirements in California. TimeCert identifies missed time punches, late meal periods, and missed meal periods, and also requires the employee through an automated process to remedy any missed punches, to correct time records that indicate that no meal period was taken but actually was taken, to identify late meal periods (i.e., those meal periods that do not commence before the end of the 5th hour of work, etc.) and to require the employee to explain the reason for late or missed meal periods and/or rest breaks.
It is critical for legal compliance that an employer collect an employee’s reason for missed meal periods and/or rest breaks, and for missed rest breaks, because the employee’s reason for not taking it or not taking it timely dictates whether the employer is in violation of the law and whether the employer owes premium pay to the employee for the missed or late meal periods and/or rest b… Voir plus
